Federal Judge: Only Powered-Off Cell Phones Deserve Privacy Protections

I have a cell, but it's not a smart phone, (I have no interest in one), and I do shut it off at night (mostly to conserve battery power), and I have the security set to "911 only", which I hope makes a difference...

I do have an iPod touch, and location information is TURNED OFF, including in all apps... I would not want a phone that does not allow you to at least minimize location tracking...
