Yep, after reading a few more articles online found out it's a rootkit... Thanks Tony

I doubt it is a RootKit. It's too obvious. RootKits hide and are mostly inconspicuous in nature.

It's just a trojan that is obfuscating its malicious intent by using the name of a legitimate file. However its loading from an illegitimate location.

This file is most often a marker for a rootkit, typically Pihar or TDL4.

Malwarebytes Anti-Rootkit Beta can address the underlying infection.
